Aggravated battery is charged as a felony in the second degree, which can be punished by up to 15 years in prison, 15 years of probation and a $10,000 fine. In addition, there may be other penalties in play, including a mandatory minimum of:
- 10 years for possessing a firearm during the battery
- 15 years if the firearm in possession was a semiautomatic
- 20 years if the firearm was discharged during the battery
- 25 years if a victim was injured or killed by the firearm
In addition, the charges can be elevated even further if the victim falls within certain classes, including elderly individuals, law enforcement officers and public officials.
